IMPORTANT — READ CAREFULLY BEFORE PURCHASING
This Waiver and Release of Liability (“Agreement”) is entered into by and between the undersigned purchaser (“Buyer”) and Pinnacle Peptide Vault(“Seller”) as a condition of the purchase of research-use-only peptides (“Products”).
Buyer acknowledges and agrees that all peptides, chemicals, and related materials (“Products”) purchased from Seller are sold for laboratory research purposes only. The Products are not intended for human consumption, animal consumption, medical use, diagnostic use, therapeutic use, or veterinary use of any kind. Buyer acknowledges that the Products have not been evaluated or approved by the U.S. Food and Drug Administration (FDA) for any use.
Buyer understands and acknowledges that the handling, storage, and use of research peptides involve inherent risks, including but not limited to allergic reactions, illness, injury, toxicity, or death. Buyer assumes all risks associated with the possession, handling, storage, misuse, or use of the Products. Seller shall not be responsible or liable for any misuse, side effects, illness, injury, damages, or losses arising from the Products, whether direct or indirect. Buyer hereby releases and discharges Seller, including its owners, officers, agents, employees, and affiliates, from any and all liability, claims, or causes of action, including claims based on negligence.
Seller makes no warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. All Products are sold “AS IS.” Buyer agrees Seller makes no guarantees regarding results, outcomes, safety, or effectiveness of any research involving the Products.
Buyer represents and warrants that they are at least 18 years of age and are legally qualified and authorized to purchase the Products for research purposes. Buyer agrees to comply with all applicable federal, state, and local laws and regulations regarding the purchase, possession, handling, storage, and use of the Products.
Buyer has been strongly advised to consult with a licensed physician or qualified medical professional before conducting any research involving the Products. Buyer acknowledges that individuals with predisposed medical conditions, including but not limited to cancer, cardiovascular disease, metabolic disorders, autoimmune conditions, or immune deficiencies, may be at increased risk of adverse effects. Buyer has been specifically advised to seek medical guidance if any such condition exists. Should Buyer nevertheless choose to use the Products in any manner inconsistent with their intended research purpose, Buyer assumes all risk of illness, injury, or death, and Seller shall bear no responsibility or liability whatsoever. Seller makes no medical claims or representations regarding safety, efficacy, or suitability.
This Agreement shall be governed by and construed in accordance with the laws of the State of California. Buyer expressly agrees that any dispute, claim, or legal proceeding arising out of or relating to this Agreement shall be brought exclusively in the Superior Court of California, County of Orange. Buyer waives any objection to jurisdiction or venue and agrees not to file or participate in any action in any other jurisdiction.
This Agreement constitutes the entire agreement between Buyer and Seller and supersedes all prior oral or written communications. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
BY PURCHASING, BUYER CONFIRMS THAT THEY HAVE READ, UNDERSTOOD, AND VOLUNTARILY AGREED TO THIS WAIVER IN ITS ENTIRETY.
